The attorney for a man whose videotaped arrest by Phoenix police made national headlines has put the city on notice that a lawsuit could be coming.
In the notice of claim, Tyron McAlpin’s attorney accuses two officers of attacking, beating and shocking McAlpin with a Taser, who is deaf and has cerebral palsy.
It claims the two officers, along with another, falsified charges against McAlpin that led to him being wrongly jailed for 24 days.
The arresting officers said McAlpin attacked them. The county attorney dismissed assault and resisting arrest charges against McAlpin and the police department is conducting an internal investigation.
McAlpin's attorney says they will settle the claim for $3.5 million.
Phoenix says it cannot comment on pending litigation.
