Maricopa County prosecutors will not file criminal charges against a Glendale police officer who shot and killed a man in early January in a case of mistaken identity.

Glendale police were looking for an armed domestic violence suspect whose ex said would not go down without a fight.

Patrols found his white truck, but window tint kept them from seeing he’d shot himself.

Officers were moving to look through the windshield, when attention turned to Dillon Siebeck sitting at a nearby park gazebo. A video briefing of the incident made by Glendale police does not show Siebeck.

An internal review of the incident by Glendale police is pending.

Lawyers for Siebeck’s family say he was unarmed, posed no threat and should still be alive.

Lawyers for the family also say the decision by prosecutors does not mean the officers involved have been cleared of wrongdoing.
