Court records say a stolen gun may have been why a Maryvale High School student fatally attacked a classmate on Tuesday. The 16-year-old accused of murder has been charged as an adult.

One witness reportedly told investigators that Chris Aguilar switched seats to sit next to Michael Montoya, then punched and stabbed him.

Other witnesses said that Montoya had been the subject of death threats for allegedly having stolen a gun from Aguilar.

Families of both teens were in court for Aguilar’s initial appearance. They heard from Deputy County Attorney Michelle Morgan.

“The defendant was the aggressor in the classroom and the victim had no ability to defend himself. The victim subsequently died of his wounds. These are very serious allegations. Someone lost their life in a school classroom where he should have been safe,” Morgan said.

Records say a four-inch knife found on campus by investigators has Aguilar’s name etched on the handle.
