Glendale police face a new lawsuit stemming from an officer-involved shooting about a year ago that was a case of mistaken identity.

Court records say Glendale police inexplicably shifted their attention from trying to see inside a vehicle where a domestic violence suspect had shot himself to Dillon Siebeck sitting in a park hundreds of feet away.

The complaint says police had no basis to believe Siebeck was the suspect, as he was twice their age and a different ethnicity.

The lawsuit filed by Siebeck’s brother accuses the sergeant on scene of failing to intervene after shots were fired and alleges the sergeant withheld medical aid for 15 minutes after Siebeck was hit.

Glendale officials did not comment on the lawsuit. On Wednesday afternoon, Glendale officials announced that one of the officers involved had been fired after internal reviews found the shooting was out of policy.
