Prosecutors have filed a murder charge against a man Phoenix police were looking for when an officer mistakenly shot and killed the wrong person.

Prosecutors say in late January, Edgar Garcia shot up a home in Laveen, then broke in and shot a person.

A witness reportedly told the first arriving officer that children inside were being shot. Seeing a struggle, the officer fired one rifle round through an open front door.

The bullet fatally struck Christian Rendon, who police say had disarmed Garcia.

Now Garcia is being charged with Rendon’s killing.

Under state law, prosecutors can file first-degree murder charges against a defendant if a death occurs while they’re committing a felony.
