The family of a man mistakenly shot and killed by Phoenix police last month has filed a $25 million notice of claim against the city and officer.
Filing a notice of claim is a required step before launching a lawsuit.
The claim in question stems from a January emergency call at a southwest Phoenix home. The document says an arriving officer was told by multiple people that a suspect was subdued and on the ground.
But despite the warnings, the officer reportedly aimed their rifle through an open doorway into a crowded living room, shouted "show me your hands" and fired 1 second later.
The bullet fatally struck Christian Diaz, identified by police as Christian Diaz Rendon, as he was sitting on top of the disarmed intruder.
The Phoenix police chief has apologized Diaz's his family.
