Arizona’s Kris Mayes has joined a coalition of other attorneys general in urging a federal judge to protect emergency abortion care in Idaho.
The group is urging the 9th U.S. Circuit to uphold a previous ruling that blocks Idaho’s strict ban, which does not allow exceptions for emergencies. At issue is the Emergency Medical Treatment and Labor Act (EMTALA), which requires hospitals to provide emergency care, including for pregnancy-related emergencies.
Mayes argues the ban puts lives in danger and burdens health care systems by driving both patients and providers out of Idaho, indicating neighboring states that pick up the slack will feel the strain on their already-limited resources.
A similar group, including Mayes, filed a second brief with the Supreme Court earlier this year that upheld protection while sending the case back to the 9th Circuit.
