Fountain Hills Town Council faces allegations of violating Arizona law on open meetings

The Arizona Attorney General’s Office is investigating the Fountain Hills Town Council for allegations that members violated the open meetings law.

The review stems from a complaint filed over a January vote that wasn’t on the meeting agenda.

The vote was to release a consultant report on wireless communication services.

An October letter from the Attorney General’s Office to the town attorney gives officials 30 days to respond to allegations that certain members broke state law and even discussed their plans ahead of time.

At a recent council meeting, the town attorney recommended the council confirm its January vote.

Resident Beth Culp said the window to do so closed in March.

“That train left the station 30 days after I notified the council that I had submitted a notice of claim,” Culp said.

Next, the council held private discussions in executive session before publicly voting to ratify the January action to release the consultant report.

Culp had warned against the move.

“And I can tell you that if you ratify that, I will file another violation claim with the attorney general,” Culp said.
