The Arizona Court of Appeals has upheld a decision to deny workers' comp benefits to an auto repair shop employee who accidentally shot himself while on the job.
Court records say the shop is located in an industrial part of Glendale, and the worker involved was not responsible for security.
But he carried a gun anyway because of homelessness and crime. While climbing into a truck cab to estimate repair costs, he accidentally shot himself in the leg.
An administrative law judge denied his workers' comp claim after finding that he chose to carry a gun at all times regardless if he was working.
Now the state court of appeals has agreed and found that the risk posed by the man’s gun was wholly personal.
